The Deliverable

Permissible Use

Purpose determines which rules apply.

U.S. background research is governed by how it will be used — and knowing which side of the line an engagement sits on is part of the work.

Investment purpose

A report used to evaluate an investment — whether to commit capital, extend credit, or underwrite a counterparty — generally sits outside the Fair Credit Reporting Act, and no consent from the subject is required.

Employment purpose

The same report used to hire, promote, retain, or remove an individual is generally a consumer report under the FCRA — triggering notice, consent, and adverse-action obligations.

Every engagement is scoped to its permissible purpose at intake, and work is conducted with careful attention to the requirements of the Fair Credit Reporting Act where they apply.
